Privacy Policy
How Trade With Canadians collects, uses, shares, and protects information across the Platform, and the rights, responsibilities, and limits that apply to your business.
This Policy forms part of a binding legal agreement. The Platform provides automated, information-only matches, insights, and suggestions, and conducts no due diligence on any user or Connection. By accessing or using the Platform you accept this Policy and the Terms of Use, including the limitation of liability and indemnification in Section 29. If you do not agree, do not use the Platform.
Identity of the Controller, Scope & Acceptance
This Privacy Policy (the “Policy”) explains how Trade With Canadians Ltd. (“TWC”, “we”, “us”) collects, uses, discloses, and protects Personal Information when you access or use the TWC platform, websites, dashboards, and related services (together, the “Platform”).
Who We Are
TWC is the controller responsible for the Personal Information processed through the Platform, except where this Policy or applicable law designates another party. TWC operates a business-to-business matchmaking service for Canadian organizations.
Platform, Services & Scope
This Policy applies to all users of the Platform, including business representatives, account holders, and visitors. It does not apply to third-party websites, products, or services that we do not control, even where they link to or from the Platform.
Business Use Only
The Platform is intended solely for business and professional use by organizations and the individuals authorized to act on their behalf. It is not directed to, or intended for, personal, household, or consumer use.
Acceptance of This Policy
By accessing, browsing, registering for, or using the Platform, you confirm that you have read and understood this Policy and agree to the processing of Personal Information as described. If you do not agree, you must not access or use the Platform.
No Reliance Beyond This Policy
This Policy, together with the Terms of Use, is the complete statement of how we handle Personal Information on the Platform. You should not rely on any statement, representation, or understanding about our privacy practices that is not set out in this Policy or required by applicable law.
Other Governing Documents
This Policy forms part of, and should be read together with, the TWC Terms of Use and any product-specific terms. Where a separate written agreement signed by an authorized representative of TWC applies, that agreement governs to the extent of any conflict.
Governing Privacy Laws
In Canada, TWC handles Personal Information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy laws, including Quebec's Law 25. Where you are located outside Canada, additional or different laws may apply, as described in Sections 19 through 21.
Definitions
Capitalized terms used in this Policy have the meanings given below, or the meaning given where first used:
- Personal Information
- information about an identifiable individual, or as otherwise defined under applicable privacy law.
- Business Information
- information about an organization, its operations, profile, or commercial activities that is not Personal Information.
- Processing
- any operation performed on information, including collection, use, storage, disclosure, and deletion.
- Platform
- the TWC websites, dashboards, applications, and related services.
- Services
- the matchmaking, profile, Insight Engine, TINA, and related features made available through the Platform.
- User
- any person who accesses or uses the Platform, including authorized business representatives.
- Connection
- a match, recommendation, or introduction surfaced by the Platform between organizations.
- Ecosystem Organization
- a public-sector, industry, or partner organization that participates in the Platform under separate arrangements.
Categories of Personal Information We Collect
We collect the categories of Personal Information described below. The specific information collected depends on how you interact with the Platform.
Identity & Contact Data
Name, business email address, business phone number, job title, organization, and similar contact details you provide when registering or communicating with us.
Business Profile & Content
Information you submit to build and operate your business profile, including descriptions, categories, capabilities, locations, documents, and other content you choose to provide.
Communications & User-Generated Content
Messages, prompts, feedback, support requests, and other content you submit through the Platform, including interactions with TINA and other features.
Transaction & Billing Data
Plan, subscription, token balance, and billing-related information. Payment-card details are processed by our payment providers and are not stored by TWC.
Service Connection & Technical Data
Device, browser, IP address, identifiers, log data, and usage information generated when you access the Platform.
Security & Audit Logs
Records of access, authentication, and activity used to operate, secure, and audit the Platform.
Cookies, Pixels & Similar Technologies
Information collected through cookies and similar technologies, as described in Section 13.
Information About Third Parties You Provide
Where you submit information about other individuals (for example, colleagues or contacts), you represent that you are authorized to do so and that the information may be processed under this Policy.
Sensitive Personal Information
We do not seek, and ask that you not submit, sensitive Personal Information. Where we collect it, we use it only as reasonably necessary to provide the Services or as permitted by law.
Sources of Personal Information
We collect Personal Information from the following sources:
- Directly from you: when you register, build a profile, communicate with us, or use the Platform.
- Automatically: through your use of the Platform, including technical and usage data.
- From your organization: where a representative or administrator provides information about you.
- From third parties and public sources: including service providers, partners, and publicly available business information, where permitted by law.
Purposes & Lawful Basis of Processing
We process Personal Information for the purposes below, relying on lawful bases such as performance of a contract, legitimate interests, consent, and compliance with legal obligations, as applicable.
- Account & profile management: to create, operate, and support your account and profile.
- Service delivery & matching: to provide the Platform, including profile-driven matching and recommendations.
- Insights & analytics: to generate summaries, strengths, gaps, and suggestions through the Insight Engine.
- Communications & notifications: to send service, transactional, and (where permitted) marketing messages.
- Security & fraud prevention: to protect the Platform, users, and TWC.
- Legal & regulatory compliance: to meet our obligations and exercise or defend legal rights.
- Improvement & development: to maintain, improve, and develop the Platform.
- Corporate transactions: in connection with a merger, financing, acquisition, or similar transaction.
Where we rely on consent, you may withdraw it at any time as described in this Policy. Withdrawal does not affect processing carried out before withdrawal, or processing under another lawful basis.
Profile-Driven Matching, Recommendations & Connections: No Due Diligence
The Platform surfaces potential Connections by processing the information in business profiles. These are automated, information-only suggestions, not endorsements, verifications, or recommendations to transact.
Information-Only Suggestions
Matches, recommendations, and Connections are generated from profile data and are provided for your convenience and consideration only. They reflect data patterns, not professional judgment about any organization.
No Due Diligence or Verification
TWC does not independently investigate, verify, vet, endorse, or guarantee any user, organization, profile, statement, capability, or Connection surfaced by the Platform.
Your Responsibility to Verify
You are solely responsible for conducting your own due diligence before contacting, contracting with, or relying on any Connection. You should independently confirm the identity, suitability, qualifications, and standing of any party.
No Liability for Connections
To the maximum extent permitted by law, TWC is not responsible or liable for the accuracy of any profile, the conduct of any user, the outcome of any Connection, or any agreement, dispute, loss, or damage arising between users. All Connections and dealings are entirely at your own risk.
TWC Insight Engine™: Summaries, Strengths, Gaps & Suggestions
The TWC Insight Engine™ processes profile and Platform data to produce summaries, strengths, gaps, and priority suggestions. Its output is informational and automated.
How It Uses Your Information
The Insight Engine analyzes information you and others provide to generate insights about your profile and potential opportunities. It does not make decisions on your behalf.
Suggestions, Not Advice
Insight Engine output consists of automated suggestions for your consideration. It is not professional, legal, financial, or business advice, and must not be relied upon as such.
Accuracy & Limitations
Output may be incomplete, inaccurate, or unsuitable for your circumstances. You are responsible for evaluating it and exercising your own judgment before acting.
No Guarantee of Results
TWC does not warrant that any insight, suggestion, or opportunity will result in a Connection, transaction, or business outcome.
TINA: Business-Only Use, No Advice
TINA is the Platform's built-in assistant. It uses generative technology to produce text in response to your prompts, for business use only.
What TINA Is
TINA is an optional convenience feature. It is not a professional, advisor, agent, or representative of TWC, and using it creates no advisory or fiduciary relationship.
Business Use Only
TINA is intended for business and professional purposes connected to your use of the Platform. Do not use it for personal, consumer, or high-risk purposes.
No Professional Advice
TINA does not provide legal, financial, tax, accounting, medical, or other professional advice. Always obtain advice from a qualified professional before acting.
Accuracy & Your Responsibility
TINA's responses are machine-generated and may be inaccurate, incomplete, or unsuitable. You are responsible for verifying output and for any decision based on it.
Inputs & Data
Do not enter confidential, sensitive, or third-party personal information into TINA without authorization. Conversations may be processed and retained to operate, secure, and improve the Platform, as described in this Policy and the TINA disclaimer.
Automated Decision-Making, Profiling & Automated Systems
The Platform uses automated systems and machine-learning models to operate features such as matching and the Insight Engine. This section explains how that processing works and your related rights.
No Automated Decisions With Legal Effect
The Platform does not make decisions that produce legal or similarly significant effects about you without human involvement. Automated output is informational and supports (but does not replace) your own decisions.
Profiling for Matching & Insights
We process profile and usage data to generate matches, recommendations, and insights. This involves analyzing business information to identify potential opportunities.
Generative & Machine-Learning Output
Some features rely on generative technology and third-party models. Output is probabilistic and may be inaccurate. It is provided “as is” for your consideration.
Known Limitations
Automated systems may produce errors, omissions, or biased results, and may not reflect current facts or circumstances. You should not rely on them as a sole basis for decisions.
Third-Party Model Providers
Where features rely on third-party providers, their availability, performance, and changes are outside our control, and TWC is not responsible for them.
Clear Mark & Outbound Communications: Special Notice
Where the Platform helps you reach or be reached by other organizations, you remain responsible for your own communications and compliance.
Purpose & Nature of Communications
Outbound communications facilitated by the Platform are business communications between organizations. TWC provides tools, not the content of your messages.
Your Compliance Posture
You are responsible for ensuring your communications comply with applicable anti-spam, marketing, and privacy laws, including obtaining any required consents.
Third-Party Contact Information: Warranty & Responsibility
Where you submit or use third-party contact information, you represent that you are authorized to do so, and you are responsible for your use of it.
No Due Diligence on Recipients
TWC does not verify recipients or the appropriateness of your communications and is not responsible for them.
No Endorsement
Facilitating a communication is not an endorsement by TWC of any party, message, or transaction.
Marketing Communications, Consent & Opt-Out
Marketing
Where permitted, we may send you marketing communications about the Platform and related services. We rely on consent or another lawful basis as applicable.
Opt-Out
You can opt out of marketing communications at any time using the unsubscribe link or by contacting us. Service and transactional messages will continue.
Text Messages
Where offered and where you opt in, we may send text messages. Message and data rates may apply, and you can opt out by following the instructions provided.
How We Share & Disclose Personal Information
We share Personal Information only as described below. We do not sell Personal Information for money.
With Other Users for Matching
Business profile information is shared with other users to enable matching and Connections, consistent with the purpose of the Platform.
With Service Providers
We share information with vendors who process it on our behalf under contractual safeguards, such as hosting, analytics, communications, and support providers.
With Model & Technology Providers
Certain features transmit content to third-party technology providers to generate output. We use providers under terms that restrict use to providing the service to us, where reasonably available.
Legal, Compliance, Safety & Enforcement
We may disclose information to comply with law, respond to lawful requests, enforce our terms, or protect the rights, safety, and property of TWC, users, or others.
Corporate Transactions
We may disclose information in connection with a merger, acquisition, financing, reorganization, or sale of assets, subject to appropriate protections.
With Your Direction or Consent
We share information as you direct or where you otherwise consent.
Aggregated or De-Identified Information
We may share aggregated or de-identified information that does not identify you, as permitted by law.
Cookies, Pixels & Similar Technologies
Categories
We use strictly necessary, functional, analytics, and (where permitted) marketing cookies and similar technologies to operate and improve the Platform.
Legal Basis & Consent
Where required, we obtain consent for non-essential cookies. Strictly necessary cookies do not require consent.
Managing Cookies
You can manage cookies through your browser settings and, where available, our cookie controls. Disabling some cookies may affect Platform functionality.
Cross-Border & International Transfers
Locations of Processing
Personal Information may be processed and stored in Canada and in other countries where we or our service providers operate.
Safeguards
Where information is transferred across borders, we use appropriate safeguards as required by applicable law, such as contractual protections.
Foreign Jurisdictions
Information processed in another jurisdiction may be subject to the laws of that jurisdiction, including lawful access by courts and authorities.
Transfer Mechanisms
We rely on recognized transfer mechanisms where required, and make further information available on request.
Retention & Deletion
Retention Principle
We retain Personal Information for as long as necessary to provide the Services, comply with legal obligations, resolve disputes, and enforce our agreements.
Criteria
Retention periods depend on the nature of the information, the purpose of processing, and applicable legal, accounting, and security requirements.
Deletion & De-Identification
When information is no longer required, we delete, anonymize, or de-identify it in accordance with our policies and applicable law.
Security Safeguards
Safeguards
We maintain administrative, technical, and physical safeguards designed to protect Personal Information appropriate to its sensitivity.
No Guarantee
No method of transmission or storage is completely secure. While we work to protect your information, we cannot guarantee absolute security, and you use the Platform at your own risk.
Your Role
You are responsible for safeguarding your credentials and for activity under your account. Notify us promptly of any suspected unauthorized access.
Shared Responsibility
Security is a shared responsibility. You should use strong credentials, keep your systems secure, and follow good security practices.
Breach & Confidentiality Incident Notification
Response
We maintain procedures to detect, assess, and respond to security and confidentiality incidents involving Personal Information.
Notification
Where required by law, we will notify affected individuals and relevant authorities of a reportable incident within the timeframes required.
Records
We maintain records of confidentiality incidents as required by applicable law.
Cooperation
We will cooperate with authorities and take reasonable steps to mitigate the effects of an incident.
Other Jurisdictions
We comply with applicable breach-notification obligations in the jurisdictions where we operate.
No Waiver of Limitations
Nothing in this Section limits the disclaimers, limitations of liability, exclusions, or indemnities in the Terms of Use, which apply with full force to any claim arising out of or relating to a security incident, to the maximum extent permitted by law.
Your Privacy Rights & How to Exercise Them
Depending on your jurisdiction, you may have rights in relation to your Personal Information. We honour the rights that apply to you under applicable law.
General Rights
Subject to applicable law, you may have the right to access, correct, delete, restrict, or object to processing, to data portability, and to withdraw consent.
How to Submit a Request
Submit a request by email to privacy@tradewithcanadians.ca with the subject line “Privacy Rights Request” and a clear description of your request.
Identity Verification
To protect your information, we will take reasonable steps to verify your identity before fulfilling a request. We may decline a request where we cannot verify identity to the level required by law.
Response Times
We respond within the timeframes required by applicable law, subject to lawful extensions, and will inform you of any extension and the reasons for it.
Fees
Requests are generally free of charge. We may charge a reasonable fee, or decline, where a request is manifestly unfounded, excessive, or repetitive, to the extent permitted by law.
Denials & Appeals
If we deny a request, we will explain the reasons where required and inform you how to appeal or escalate, including to a competent regulator.
Limits & Exceptions
Rights are subject to exceptions under applicable law, for example, where a request would adversely affect the rights of others, reveal confidential information, or is subject to legal privilege or legal hold.
California & Other U.S. State Privacy Rights
Categories Collected, Used & Disclosed (CCPA/CPRA)
We collect and use the categories of Personal Information described in this Policy for the business purposes described herein. We have not “sold” Personal Information for monetary consideration.
Sensitive Personal Information
We do not use or disclose sensitive Personal Information for purposes that require an opt-out under the CPRA, beyond what is reasonably necessary to provide the Services.
California Rights
California residents may have rights to know, access, delete, correct, and to limit the use and disclosure of sensitive Personal Information, subject to exceptions and verification.
Other U.S. States
Residents of other U.S. states with comprehensive privacy laws may have comparable rights. We honour applicable opt-out preference signals where required by applicable law.
Shine the Light
California residents may request information regarding certain disclosures of Personal Information for third-party direct-marketing purposes. We do not disclose Personal Information for such purposes.
EEA, UK & Swiss Rights (GDPR / UK GDPR / Swiss FADP)
Rights
If you are in the EEA, UK, or Switzerland, you have the rights described in Section 18, including access, rectification, erasure, restriction, portability, and objection, subject to applicable exceptions.
Legitimate-Interests Balancing
Where we process Personal Information on the basis of legitimate interests, we have balanced those interests against your rights and freedoms. You may request further information about that balancing.
Representative & Data Protection Officer
Where required, individuals may direct enquiries to privacy@tradewithcanadians.ca, and we will route them appropriately.
Supervisory Authorities
You have the right to lodge a complaint with the supervisory authority in your country of residence, place of work, or place of the alleged infringement.
Quebec (Law 25) Specific Disclosures & Rights
Privacy Officer
TWC has designated a person responsible for the protection of Personal Information, who can be contacted at privacy@tradewithcanadians.ca (Attention: Privacy Officer).
Privacy-Impact Assessments
Where required by Quebec Law 25, we conduct privacy-impact assessments before transferring Personal Information outside Quebec or undertaking certain projects.
Specific Rights
Quebec residents may have the right to be informed of and access Personal Information held about them, to request information about automated decisions, and to lodge a complaint with the CAI.
Confidentiality Incidents Register
TWC maintains a register of confidentiality incidents as required by Quebec Law 25.
Children's Privacy
The Platform and Services are intended exclusively for business use by adults of full legal capacity. The Platform is not directed to, intended for, or available to children, and TWC does not knowingly collect Personal Information from children. If you believe a child has provided Personal Information to TWC, contact privacy@tradewithcanadians.ca and we will take appropriate steps to delete it.
Third-Party Services, Links & Integrations
The Platform may contain links to, or integrate with, third-party websites, applications, services, and partner platforms. Those third parties are independent, and TWC is not responsible for their content, practices, or privacy policies. Once Personal Information is transmitted to a third party, that third party's privacy policy and terms govern its handling. Review those policies before sharing Personal Information.
Complaints & Regulator Contacts
If you have a concern about how TWC handles Personal Information, please contact privacy@tradewithcanadians.ca so we can address the matter promptly. You may also lodge a complaint with a competent regulator, including:

Public-Sector & Ecosystem Organizations
Unless TWC has entered into a separate written agreement signed by an authorized representative stating otherwise, nothing in this Policy creates any additional procurement, freedom-of-information, access-to-information, data-residency, audit, public-sector compliance, or similar obligation for TWC beyond what applicable law requires. Where an Ecosystem Organization participates in the Platform, it is responsible for its own compliance obligations, and its participation does not subject TWC to public-sector privacy or transparency regimes unless expressly agreed in writing.
De-Identified, Aggregated & Anonymized Information
TWC may de-identify, aggregate, or anonymize Personal Information so that it does not reasonably identify any individual. TWC may use and disclose such information for any lawful purpose, including improving the Services, research, benchmarking, analytics, and reporting. TWC commits not to attempt to re-identify de-identified or anonymized information except as permitted by law.
Research, Model Training & Analytics
TWC may use Personal Information, de-identified data, and Business Information to research, design, train, validate, and improve the Platform, including its matching, Insight Engine, TINA, and automated and machine-learning features. Where we rely on third-party providers, we do so under terms that restrict their use of Platform content to providing the service to us, and we do not authorize third parties to train their own general-purpose models on Platform content unless separately permitted. Where consent is required for a specific research or training use under applicable law, TWC will obtain it before processing.
International Users / Foreign Jurisdictions
TWC is based in Canada and applies Canadian privacy standards as a baseline. Additional disclosures or rights may apply depending on your jurisdiction, as described in Sections 19 through 21. The Services are not directed to any jurisdiction where their offering or use is prohibited or restricted. You are responsible for compliance with the laws of your jurisdiction, including in connection with any cross-border use, data export, or import-control regime.
Relationship to Terms of Use; Liability & Indemnification
This Policy is incorporated into, and governed by, the Terms of Use. The disclaimers, limitations of liability, exclusions, liability cap, indemnities, arbitration or dispute provisions, and governing-law provisions of the Terms of Use apply with full force to this Policy and to any matter relating to Personal Information or privacy.
To the maximum extent permitted by applicable law, Trade With Canadians Ltd. and its affiliates, directors, officers, employees, agents, licensors, and suppliers (the “TWC Parties”) will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, business, or opportunity, arising out of or relating to the processing of Personal Information, your use of the Platform, or any Connection, even if advised of the possibility of such damages.
The TWC Parties are not liable for the conduct of other users, the accuracy of any profile or output, or the outcome of any Connection, communication, or transaction.
To the fullest extent permitted by law, the TWC Parties' total aggregate liability for all claims relating to privacy or this Policy will not exceed the greater of (a) the amounts you paid TWC in the three (3) months before the event giving rise to the claim, or (b) CAD $100.
Some jurisdictions do not allow certain exclusions or limitations; where that applies, the above apply to the fullest extent permitted by law and do not affect non-waivable statutory rights.
You agree to defend, indemnify, and hold harmless the TWC Parties from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the Platform, your content, your communications, your reliance on any output or Connection, or your breach of this Policy or applicable law.
This Policy is governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, as set out in the Terms of Use.
Changes to This Policy
We may update this Policy from time to time. The “Last updated” date at the top of this Policy indicates when it was last revised. For material changes, we will provide additional notice where required by applicable law. Your continued use of the Platform after the effective date of an update constitutes acceptance to the extent permitted by law.
Language
The parties confirm that it is their express wish that this Policy and all related documents be drawn up in the English language only. Les parties confirment leur volonté que la présente politique ainsi que tous les documents qui s'y rattachent soient rédigés en langue anglaise seulement. Where a translation is required by law or made available, the English-language version controls to the maximum extent permitted by law.
Contact Information
Acknowledgment
By accessing, browsing, registering for, using, integrating with, or otherwise interacting with the Platform or Services in any way, you acknowledge and agree that:
- You have read, understood, and agree to this Privacy Policy in its entirety, including the disclosures regarding automated processing, output, matching, the Insight Engine, TINA, Connections, and cross-border transfers.
- You agree to be bound by the Terms of Use, including the disclaimers, limitations of liability, indemnities, and limitation-of-liability and indemnification provisions referenced in Section 29.
- Where you submit third-party contact information, you represent and warrant that you hold the necessary rights and agree to indemnify TWC as set out in this Policy and the Terms of Use.
- If you are using the Platform on behalf of an organization, you have the authority to bind that organization, and “you” refers to both you and that organization.
